Personally I would throw out the application. The nintendo DS is a handheld
device with a display on a different surface to the touch sensitive element
so anticipates claim 1 while all subsequent claims are standard GUI elements
implemented using claim 1 as the pointing device. This assumes a plain
language interpretation of the claims by an occasional programmer.
Having said that, with the standard of patent examination in the US I would
expect it to be granted in a few years' time, at which point someone will
have to go to court to invalidate it.
