Not quite.
The product has to be 'CE marked' - which is basically just the process 
of putting a label on it.
You can even self-certify, and put the sticker on with no tests 
completely legally.

However. If challenged, you need to provide a technical construction 
file, which has details of why you believe that it cannot break the 
assorted regulations. (For example, a computer inside a 6" thick welded 
metal shell, that runs off batteries and communicates accoustically)

If it's not obvious that it can't break the assorted (EMI, ...) 
regulations, then if you haven't done the tests, and it does not comply, 
you have problems. Theoretically up to jail time and huge fines. 
Practically for FIC - nobody'd sell it, and it could get confiscated at 
customs.
